Use of the Site implies your express consent to these Terms applying to you, without prejudice to any particular terms established for specific services.

  • Site: the website www.hyper.mx and its pages, content and features.
  • User or you: any person who accesses or uses the Site.

3. Who we are and our regulatory status

Hyper is an insurance and bonding agent authorized by Mexico's National Insurance and Bonding Commission (Comisión Nacional de Seguros y Fianzas, CNSF). Hyper acts as an intermediary between you and the Insurers and Bonding Companies: it does not assume risks or issue policies or bonds on its own account.

Coverage, conditions, exclusions and every other obligation arising from an insurance policy or bond rest exclusively with the Insurer or Bonding Company that issues it. You will find more information about our activity as intermediaries in the Intermediation Information Brochure, available at www.hyper.mx/legal/folleto-informativo-intermediacion.

4. Use of the Site

You agree to use the Site lawfully, in good faith and in accordance with these Terms. The following is prohibited, among other things:

  • Use the Site for unlawful or fraudulent purposes, or purposes contrary to morality and public order.
  • Provide false or inaccurate information, or information belonging to third parties without their authorization.
  • Attempt to gain unauthorized access to systems, accounts, networks or databases of Hyper or of third parties.
  • Introduce viruses, malicious code or any element that damages, overloads or interferes with the operation of the Site.
  • Extract, copy or collect Site content or data by automated means, except with Hyper's prior written authorization.
  • Impersonate another person or pose as a representative of Hyper, an Insurer or a Bonding Company.
  • Reproduce, distribute or commercially exploit the Site or its Content without authorization.

5. Informational nature of the Site

The information published on the Site about insurance, bonds, coverages, industries and services is purely informational and of a general nature. It does not constitute a binding offer, a personalized recommendation, legal, tax or financial advice, or a promise of risk acceptance or of the issuance of any policy or bond.

Hyper strives to keep the information on the Site current and accurate, but does not guarantee that it is free of errors or omissions and may update or modify it at any time without prior notice.

6. Quotes and contracting

Quotes, proposals or premium estimates that Hyper provides to you are indicative and are prepared with the information you supply. They are subject to review and acceptance by the relevant Insurer or Bonding Company, so they may vary or may not materialize.

The insurance or bonding contract is concluded only when the Insurer or Bonding Company issues the corresponding policy or bond. The general, particular and special conditions of the issued policy or bond govern the relationship between you and the Insurer or Bonding Company, and prevail over any information published on the Site.

You are responsible for the accuracy and sufficiency of the information you provide to obtain a quote or to contract. Omitted or inaccurate data may affect risk acceptance, the premium amount or the payment of a claim under applicable law.

7. Hypernet, HyperSign and access credentials

Access to Hypernet and HyperSign is through personal, non-transferable credentials. You alone are responsible for keeping them confidential, for all transactions carried out with them, and for immediately notifying Hyper of any unauthorized use or suspicion of it.

You acknowledge and agree that the access data, verification codes, and authentication and electronic signature mechanisms that Hyper makes available to you replace your handwritten signature and produce the same effects, in accordance with the Commercial Code (Código de Comercio) and other applicable legislation on data messages and electronic signatures. Documents and consents given by these means are fully enforceable against you and may be kept in electronic format.

Hyper may suspend or cancel access to these tools when it detects misuse, a breach of these Terms or a risk to information security.

8. Availability of and changes to the Site and the platforms

Hyper may modify, suspend or discontinue, temporarily or permanently, the Site, Hypernet, HyperSign or any of their features, and may carry out maintenance windows, without prior notice and without liability for Hyper.

Hyper is not obliged to keep any particular feature or content available, or to ensure that the Site or the platforms operate without interruption.

9. Intellectual property

"Hyper", the logos, trademarks, trade names, designs, texts, images, software and other Content of the Site are owned by Hyper or used with authorization from their owners, and are protected by the Federal Copyright Law, the Federal Law for the Protection of Industrial Property and other applicable provisions.

These Terms grant you no license or right over such elements, other than personal, non-commercial use of the Site. Their reproduction, modification, distribution, public communication or any other use without Hyper's prior written authorization is prohibited.

10. Suggestions and feedback

Any ideas, suggestions or comments you send to Hyper about the Site or its services may be used by Hyper freely and without any obligation of consideration, compensation or acknowledgment in your favor.

These channels must not be used to send personal data; the processing of any personal data is governed exclusively by Hyper's Privacy Notice.

11. Links to third-party sites

The Site may contain links to third-party sites or services, including those of Insurers and Bonding Companies. Hyper does not control or endorse those sites, is not responsible for their content, availability or policies, and you access them at your own risk and subject to each third party's terms.

12. Cookies and similar technologies

The Site uses cookies, web beacons and other similar technologies, as described in Hyper's Privacy Notice, available at www.hyper.mx/legal/privacidad. By browsing the Site, you acknowledge their use in accordance with that notice.

You may configure your browser to limit or disable these technologies, which could affect some features of the Site.

13. Disclaimer of warranties

To the extent permitted by law, the Site and its Content are provided "as is" and "as available", without warranties of any kind, express or implied, including those of accuracy, fitness for a particular purpose or continuous availability, without prejudice to section 5.

Nothing in this section excludes the rights that applicable law recognizes for you as a user of financial services.

14. Limitation of liability

To the maximum extent permitted by law, Hyper will not be liable for:

  • Interruptions, failures or unavailability of the Site, Hypernet or HyperSign, when arising from causes beyond its control or from maintenance.
  • Damage caused by viruses or other harmful elements that, despite its security measures, may affect your equipment when using the Site.
  • A decision to contract or not to contract insurance or a bond based solely on the general information on the Site.
  • Risk acceptance, conditions, payment of claims and other obligations that correspond to the issuing Insurer or Bonding Company.
  • Misuse of access credentials for reasons attributable to you.

The foregoing does not limit any liability that Hyper has under applicable law as an insurance and bonding agent.

15. Indemnification

You agree to hold harmless Hyper, its officers, employees and representatives from any claim, damage, loss or expense, including reasonable attorneys' fees, arising from your breach of these Terms or your unlawful use of the Site, Hypernet or HyperSign.

16. Term and termination

These Terms remain in force while you use the Site. Hyper may restrict, suspend or cancel your access to the Site or the platforms in the event of a breach of these Terms, without prejudice to any other legal remedies available to it.

Provisions that by their nature should survive termination, including those on intellectual property, limitation of liability, indemnification and jurisdiction, will remain in force.

17. Personal data protection

The processing of personal data you provide through the Site, Hypernet or HyperSign is governed by Hyper's Privacy Notice, available at www.hyper.mx/legal/privacidad. For any matter related to your personal data or the exercise of your ARCO rights, you may write to privacidad@hyper.mx.

18. Complaints and clarifications

If you have a question, complaint or clarification about Hyper's intermediation services or about a policy or bond, Hyper will support you in handling it with the relevant Insurer or Bonding Company.

Additionally, you may go to the Specialized Unit for Inquiries and Claims (Unidad Especializada de Atención de Consultas y Reclamaciones, UNE) of the Insurer or Bonding Company concerned and, where applicable, to the National Commission for the Protection and Defense of Financial Services Users (Comisión Nacional para la Protección y Defensa de los Usuarios de Servicios Financieros, CONDUSEF), in accordance with applicable law.

19. Changes to the Terms

Hyper may modify these Terms at any time. Changes take effect upon publication on the Site, so we recommend that you review them periodically. Continued use of the Site after publication implies acceptance of the modified Terms.

20. General provisions

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will retain their full validity (severability). Hyper's failure to exercise a right does not imply a waiver of it.

These Terms, together with the Privacy Notice and any specific terms established for Hypernet or HyperSign, constitute the entire agreement between you and Hyper regarding use of the Site.

21. Governing law and jurisdiction

These Terms are governed by the federal laws of the United Mexican States. For their interpretation and performance, you and Hyper submit to the jurisdiction of the competent courts of Mexico City, waiving any other venue that may correspond to them by reason of their present or future domicile.
